UNCLAS SANTO DOMINGO 004794 SIPDIS STATE FOR PM/RSAT-BERNETA LEE; WHA/CAR-DAVID SEARBY E.O. 12958: N/A TAGS: MASS, MARR, DR, KTIA, PGOV SUBJECT: MILITARY GRANT ASSISTANCE LEGAL REQUIREMENTS: DOMINICAN REPUBLIC REF: STATE 005897 1. Embassy has received a diplomatic note dated October 21 from the Dominican Republic's MFA accepting the proposed language change to the 1974 bilateral agreement on net proceeds from sales of items provided under grant military assistance, to conform to Section 505(f) of the Foreign Assistance Act of 1961. The note was in response to the Embassy's diplomatic note No. 16 of February 4, 2005, which contained English text per para 5 reftel and a Spanish translation; the MFA sent a diplomatic note with an interim reply on March 17, indicating that the issue had been forwarded to competent authorities for decision. 2. The operative language in the October 21 diplomatic note (informal translation) states: "The Ssecretariat of State for Foreign Relations of the Dominican Republic has the honor to confirm to the Embassy ofthe United States of America that the Government of the Dominican Republic is in agreement with the aforementioned proposal. The Embassy's note and the note of the Secretariat constitute an agreement between the two Governments, which will enter into force on the date of this note." 3.
