1.  (SBU)  Post received October 4, a diplomatic note from 
the Office of the Under Secretary of the Ministry of Foreign 
Affairs reaffirming that the GOK will detain and try five of 
the Kuwaitis currently held in Guantanamo upon their return 
to Kuwait, as requested ref C.  Post's unofficial translation 
of the note is provided below.  (Arabic text is being faxed 
to NEA/ARPI.)

October 2, 2005

The Ministry of Foreign Affairs presents its compliments to 
the Embassy of the United States of America and has the honor 
to refer to the Embassy's note number 687 dated September 21, 
2005 about the decision of the Government of the United 
States of America to return five of the Kuwaiti detainees at 
Guantanamo to the State of Kuwait: 
 
--  Abdullah Saleh Ali Al-Ajmi, 
--  Abdulaziz Sayer Owain Al-Shammari, 
--  Adil Zamil Abdul Mohssin Al-Zamil, 
--  Mohammed Funaitel Al-Dihani, and 
--  Saad Madai Saad Al-Azmi. 
 
Regarding the obligations of the Government of the State of 
Kuwait, we reconfirm that all concerned parties will take the 
necessary legal measures, in accordance with Kuwaiti law, 
against the detainees immediately upon their return. 
Likewise, we reconfirm our acceptance of all of the 
conditions proposed by the U.S. in its note on the subject of 
returning the detainees. 
 
The Ministry of Foreign Affairs restates to the concerned 
American parties that this note should be considered written 
assurance that the Government of the State of Kuwait will 
take responsibility for the detainees upon their return to 
Kuwaiti authorities.

approximate release date so that we may advise the GOK to 
make the necessary travel arrangements.  End action request.
