C O N F I D E N T I A L CAIRO 005589 SIPDIS FOR S/WCI AND NEA/ELA E.O. 12958: DECL: 07/11/2015 TAGS: PTER, KISL, PHUM, EG SUBJECT: MODIFIED GOE ASSURANCES ON RETURN OF EGYPTIAN GTMO DETAINEES REF: CAIRO 5303 AND PREVIOUS Classified by Acting DCM Michael Corbin for reasons 1.4 (b) and (d). 1. (C) The Embassy has received a memorandum from the Egyptian General Intelligence Service (EGIS) amending the memorandum described reftel concerning the proposed return to Egypt of three Egyptians detained at Guantanamo Bay, Cuba. The memorandum is identical in text to the one described reftel, but adds a third name, that of Egyptian Abdel Rahman Mohamed Al-Marzouq to the two in the original memorandum. The memo bears the same date and number as the original. 2. (C) EGIS again provided an English translation that again did not accurately translate the document. The Arabic text should be considered authoritative. We will send the Arabic text of the modified memorandum to NEA to pass to S/WCI via classified fax. 3. (C) The following is an informal Embassy translation of the complete text of the memo: Begin Text Note number: 74 Date: 10 July 2005 Subject: Egyptian Nationals Detained at Guantanamo Naval Base, Cuba: -- Abdul Rahman Mohamed Al Marzouq -- Alaa Mohamed Selim -- Samy Abdelaziz Salem Allaithy In the context of your preparations to release the above mentioned detainees, we are willing and in agreement with their repatriation to Egypt. These subjects will be treated humanely, according to Egypt's law and its international obligations, which allow for visits and prescribe their good treatment, should they be imprisoned for legal reasons. We should note that Egyptian Alaa Mohammed Selim is one of the defendants in Supreme State Security case number 401/87 against the "Jihad Organization." End text. 4. (C) Note: As discussed reftel, although the document is not signed, it came in the standard format for written communication through liaison channels. The State Security Court case mentioned in the memo obviously refers back to 1987. The Embassy does not have any records of this case on file. State Security Court records are generally sealed from the public, and the Egyptian Ministry of Justice would probably be unable to provide us with any details. 5. (C) EGIS conveyed verbally to ORA officer that once the USG makes notification of the time and date of any flight returning the three detainees to Egypt, it will make arrangements to take them into custody upon arrival, for investigation and possible prosecution.
