SUBJECT: DJIBOUTI NEC: FINAL ACTION ITEMS PRIOR TO

1. Transmitted herewith is a translation of the 
French text of Diplomatic Note 584/05/fax of July 12, 
2005 from the Ministry of Foreign Affairs and 
International Cooperation on the Djibouti NEC.(also 
reported septel) 
 
Begin translation: 
 
The Ministry of Foreign Affairs and International 
Cooperation presents its compliments to the Embassy of 
the United States of America in Djibouti and referring 
to its Diplomatic Note No. 074 dated 29 June 2005, has 
the honor to notify the Embassy of the following 
points: 
 
Zoning: 
 
The Government of the Republic of Djibouti approves 
and confirms that the Government of the United States 
of America possesses a legal authorization to 
construct its new embassy compound including a 
warehouse and utility building on the site located in 
Haramous currently zoned residential. 
 
Haramous Development Plan: 
 
The Government of the Republic of Djibouti assures 
that the final development plan for the Haramous area 
will not substantially differ from the plan presented 
to the Government of the United States of America when 
the Conditional Purchase Agreement was signed. 
 
Maximum Building Areas Under Roof: 
 
The Government of the Republic of Djibouti approves 
the request for 12,000 gross square meters under roof 
as needed by the Embassy of the United States. 
 
Maximum Height of Perimeter Wall: 
 
The Government of the Republic of Djibouti authorizes 
the construction of a solid wall and a steel picket 
fence and of a building height along the perimeter of 
6.5 meters above finished grade. 
 
Vehicular access: 
 
The Government of the Republic of Djibouti renews its 
proposal for the access routes as contained in the map 
sent on the 13 June 2005 by letter of the Minister of 
Finance and Economy number 490/MEFPP. The Government 
of the Republic of Djibouti advises the embassy that 
said proposal constitutes the sole and last 
alternative.  If this proposal is not acceptable to 
the Embassy, the Government of Djibouti is prepared to 
grant (i.e. make available) a new parcel of land in 
the Haramous area. 
 
Water Well: 
 
The Government of the Republic of Djibouti advises the 
embassy that the provisioning of water will be assured 
by the local water authority, ONED, and regrets that 
it cannot authorize the Embassy to access the aquifer 
located at 200 feet below grade. 
 
Cultural: 
 
The Government of the Republic of Djibouti confirms 
that the site is not culturally significant. 
 
 
The Ministry of Foreign Affairs and of International 
Cooperation avails itself of this opportunity to renew 
to the embassy of the United States of America the 
assurances of its highest consideration.
