1.  (U)  This cable contains an action request.  See 
paragraph 5. 
 
2.  (U)  On February 11, 2005, two fugitives were returned 
from the Dominican Republic to the United States in the 
company of a U.S. Marshal.  Denny Alberto Sandoval, reftel A, 
is wanted to stand trial in the Southern District of New York 
on federal narcotics charges.  Jose Antonio Capellan, reftel 
B, is wanted in the Southern District of New York to be 
sentenced and serve his sentence for a guilty plea on a 
federal narcotics charges. 
 
3.  (U)  Both fugitives were arrested by the Dominican 
National Directorate for Drug Control (DNCD) on arrest 
warrants issued based on USG requests for extradition.  Upon 
learning that they had been arrested on extradition requests, 
both fugitives asked to waive their rights to an extradition 
hearing and be returned as soon as possible to the United 
States.  In consultation with the Dominican Assistant 
Attorney General in charge of extradition cases, Dr. Gisela 
Cueto, both fugitives executed a witnessed, notarized 
affidavit indicating their desire to voluntarily return to 
the United States to stand trial or serve sentences. 
 
4.  (U)  The return of Sandoval and Capellan represent the 
fourteenth and fifteenth fugitives subject to extradition 
returned to the United States during the second 
administration of President Leonel Fernandez.  They are the 
first and second fugitives returned from the Dominican 
Republic to the United States in 2005. 
 
5.  (U)  ACTION REQUEST.  The Dominican Attorney General's 
office has requested the USG provide it with the final case 
disposition and sentences in all cases in which a fugitive 
subject to extradition is returned to the United States. 
Embassy Santo Domingo requests the Department and the 
Department of Justice provide us case disposition and 
sentencing information on Sandoval and Capellan as soon as it 
becomes available.
